Requirement for Security Bonds under Section 960S of TCA 1997

The Tax and Duty Manual: Requirement for Security Bonds - Section 960S TCA 1997 has been amended to reflect changes to the provisions enabling Revenue to seek bonds from businesses in certain circumstances.

Section 960S TCA 1997 as amended provides that the Revenue Commissioners may require a taxpayer to provide security for taxes which may become due in the future where:

  • Revenue has concerns that certain fiduciary taxes will not be paid, and
  • such taxes are not paid within 30 days of the due date.

The likelihood of future revenues being at risk may be established based on the compliance history of the business and casework outcomes together with any other relevant information available on the case.
