In R v IRC ( ex parte Roux Waterside Inn Ltd) 1997 STC 781 there was a transfer from one pension scheme to another. Approval was withdrawn from the scheme as Revenue considered that the transfer was devised to avoid restrictions imposed as a condition of approval.
