579C Death of trustees: special rules

Special rules apply where section 579B has application as a result of the death of a trustee of the settlement, and within the period of 6 months beginning with that death, the trustees of the settlement again become resident and ordinarily resident in the State. In such circumstances section 579B is to apply as if the defined assets were restricted to such assets which were disposed of by the trustees in the period which begins with the death and ends when the trustees again become resident and ordinarily resident in the State.

Where the trustees of a settlement become resident and ordinarily resident in the State as a result of the death of a trustee, and within 6 months of that death section 579B has application, the defined assets are restricted to assets which were acquired after the death.
