Revenue Precedents

The question arose as to the extent of credit available to beneficiaries in respect of tax paid by executors. The executor is liable to tax at the standard rate on the gross income of the estate but can only make distributions out of the net income (gross income less management expenses). Form R185 issued by executors should reflect this, the executors should not issue certificates for the gross income received by them. IT902008
