Protected disclosures/whistleblowing
Welcome to the Institute's pages on the topic of protected disclosures or whistleblowing. Here you will find useful information on the topic as it relates to Ireland and the UK. There is a very large volume of information and resources available in this area. These webpages divide the topic into a number of headings and centralise information and resources under these headings for members to help them understand and comply with obligations.
What is whistleblowing?
Whistleblowing ,speaking up ,"bell ringing" (as its known in the Netherlands) is a wide term. The resources on these pages focus on the making of a protected disclosure and in particular protected disclosures legislation and guidance.
Whistleblowing is more formally known as ‘making a protected disclosure’. The law protects persons who raise concerns about possible wrongdoing in the workplace. They are also protected if they are dismissed or penalised for reporting a possible wrongdoing.
In the following pages we provide information and resources to members on matters such as:
- the applicable legislation,
- who is protected,
- what kind of disclosure of information is protected,
- what do firms have to do to comply with whistleblowing legislation,
- when do they have to do it,
- reporting obligations,
- confidentiality,
- data protection considerations.
These pages are provided as resources and information only and nothing in these pages purports to provide professional advice or definitive legal interpretation(s) or opinion(s) on the applicable legislation or legal or other matters referred to in the pages.
