The General Practitioners Guide to Corporate Insolvency (ROI)

Summary

2023 has seen a distinct increase in the number of companies requiring the services of a Corporate Recovery specialist.  General Practitioners need to be able to advise their client companies, when they require turnaround, restructuring or insolvency.  This course will explain how to identify when each course of action is appropriate.

  • The practical differences between turnaround, restructuring and liquidation
  • How to approach a corporate turnaround
  • Financial Restructuring/Creditors Voluntary Liquidations
  • SCARP – procedures and key elements to a successful SCARP
  • Examinership – procedures and key elements to a successful Examinership
  • Organising a creditors meeting
  • Format of creditors meeting/Looking at proceedings from the creditors’ perspective
  • How a Director should approach a creditors meeting/ How a creditor should approach an insolvent meeting
  • Directors duties – the do’s and don’t’s

Key Learning outcomes

Clearly and concisely consider a client’s options and advise on their duties and responsibilities.

The participant can help their client determine whether it is possible to:

  • Informally turnaround a business
  • Formally restructure the business

If neither of the above are viable options, the participant will be able to explain the processes and procedures of creditors voluntary liquidations and assist them navigate through the procedure in a positive manner..

Speaker Bio

Tom Murray - Tom is a partner in Friel Stafford and is one of Ireland’s most experienced corporate recovery and turnaround practitioners and was one of the first Personal Insolvency Practitioners licensed in Ireland. He is engaged by the Institute as a lecturer for their CPD (Continuous Professional Development) in the area of Corporate Recovery, Insolvency and Personal Bankruptcy. Tom has written and presented two of the six modules in the Diploma in Insolvency run by Chartered Accountants Ireland. Tom is the chair of CCAB-I’s insolvency committee.
